These Terms of Use ("Terms") govern your use of the online booking, scheduling, client-intake, and appointment-messaging platform (the "Platform") provided by Enterprise Ultra ("Enterprise Ultra," "we," "us," or "our"). You are using the Platform to book and manage appointments. By using the Platform, you agree to these Terms.
To book appointments, you must provide accurate and complete information, including your name, phone number, and email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, and for providing truthful intake information so the Provider can deliver safe and appropriate service.
Your appointment, cancellation, no-show, late-arrival, payment, gift-card, health-and-safety, records, and treatment terms are set by the business you booked with and are presented to you by the Provider — including any intake consent you complete and any policy shown at the time of booking. Those Provider policies, not these Terms, govern the service itself. Enterprise Ultra surfaces and enforces the Provider's policies through the Platform but is not responsible for them.
Messages from the business you booked with. When you provide your phone number and book an appointment, the business you booked with sends you transactional SMS — appointment confirmations and reminders, waitlist notices, and replies to messages you send them. That business is the sender of those messages and is registered with the mobile carriers under its own name.
Messages from Enterprise Ultra. If you hold an Enterprise Ultra account, we send you account and security messages directly — most commonly a one-time verification code when you sign in. Enterprise Ultra is the sender of those messages.
For both, message frequency varies with your activity; message and data rates may apply. Reply STOP at any time to opt out, or HELP for assistance. We do not send marketing or promotional messages without separate express consent. Providing a mobile number is optional: Enterprise Ultra account holders may receive sign-in codes by email instead, and agreeing to receive text messages is never a condition of creating an account, signing in, booking, or making a purchase. Mobile information will not be sold or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties, excluding the aggregators and messaging providers that transmit the messages at our direction.
You agree not to misuse the Platform, including by attempting to access it without authorization, disrupting its operation, scraping or harvesting data, impersonating others, or using it for any unlawful purpose. We may suspend or terminate access that violates these Terms.
The Platform and its contents — software, text, design, and Enterprise Ultra logos and marks — are the property of Enterprise Ultra and are protected by copyright and trademark law. The names, logos, and marks of the business you booked with remain the property of the Provider. You may not reproduce, distribute, or create derivative works from the Platform without our written permission.
The Platform is provided "as is" and "as available." Enterprise Ultra does not warrant that the Platform will be uninterrupted or error-free. Enterprise Ultra makes no warranties regarding, and is not responsible for, the services provided by the business you booked with, which are the sole responsibility of the Provider.
To the maximum extent permitted by law, Enterprise Ultra shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, or from any service provided by the Provider. Enterprise Ultra's total liability for any claim relating to the Platform shall not exceed the greater of the amount you paid to Enterprise Ultra (if any) for use of the Platform, or one hundred U.S. dollars ($100).
You agree to indemnify and hold harmless Enterprise Ultra, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, and any dispute relating to the Platform shall be resolved in the state or federal courts located in Massachusetts. Disputes concerning the services themselves are governed by the business you booked with's own terms and the law of the state in which the service is provided.
We may update these Terms from time to time. The "Last Updated" date above indicates the most recent revision. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
Your use of the Platform is also governed by our Privacy Policy.
